FOLLOW-UP ON THE NEWS: Court Dismisses Lawsuit to Restore Route 76 Bus

A Supreme Court Judge has dismissed a lawsuit brought by Chairman of the Board of Legislators Ken Jenkins to restore the Route 76 bus line in Rye.

A Supreme Court Judge has dismissed a lawsuit brought by Chairman of the Board of Legislators Ken Jenkins to restore the Route 76 bus line in Rye. The route was cancelled in the 2012 budget owing to the fact that “the bus line was costing County taxpayers $243,436 a year to service 30 passengers,” according to the County Executive’s Office.

“This is a victory for taxpayers. The level of subsidy wasn’t affordable, sustainable, or smart,” said County Executive Robert P. Astorino. “The $240,000 in contract savings has been put to work in stabilizing the finances of the overall Bee-Line system.”

The 2012 budget maintained bus fares at current levels. Service on the system also remains intact. The only change was the cancellation of the contract with the Rye- Port Chester bus company that operated a single route for the County.

Under the new arrangement, the stops on the current Route 13 bus have been expanded to serve several of the stops formerly served by the Route 76 bus. The change has allowed passengers, for the first time, to ride from White Plains to Rye without transferring buses.

Acting Supreme Court Justice Robert Neary wrote that efforts to restore the Route 76 bus line were “rendered moot by the passage and implementation of the 2013 budget.”
